Program Description: Upon consent, participants receive SMS messages that may include: appointment confirmations and reminders, service or support notifications, receipts/transaction alerts, and occasional promotional offers related to our services. Message frequency varies based on user activity and preferences.

4.) Opt‑In and Consent

a) Website Form Opt‑In: Users may opt in via the form available on our Site. The form includes a checkbox (unchecked by default) requiring users to affirmatively agree to receive SMS messages from Evo Marketing LLC.

b) Keyword Opt‑In: Users may also opt in by texting START to +1 (725) 302-1323.

c) Recordkeeping: We maintain records of consent (timestamp, source, and the phone number) within our CRM for compliance and audit purposes.

d) Consent Not a Condition: Your consent to receive SMS messages is not a condition of purchasing any goods or services.

5.) Message and Data Rates; Frequency

Message and data rates may apply. Message frequency varies. Contact your wireless provider for details about your text or data plan.

6.) Opt‑Out (STOP) Instructions

You can cancel the SMS service at any time. Text STOP to +1 (725) 302-1323. After you send STOP, we will send a confirmation SMS to confirm you have been unsubscribed. You will no longer receive SMS messages from us unless you opt in again (see Section 7).

7.) Rejoin Instructions

11.) Compliance With Industry Standards and Laws

a) We endeavor to comply with all applicable laws and regulations governing SMS communications, including the Telephone Consumer Protection Act (TCPA), CAN‑SPAM (as applicable to SMS), and applicable state laws.

b) We follow CTIA and carrier guidelines for consent, content, message delivery, and opt‑out handling.

c) You agree not to use our services to send prohibited or unlawful content, including content that violates CTIA guidelines or applicable law.

12.)Prohibited Conduct and Content

You agree not to submit or transmit content that is illegal, harmful, deceptive, infringing, harassing, hateful, or otherwise objectionable; that contains malware; that infringes intellectual property or privacy rights; or that violates CTIA rules (e.g., restricted “SHAFT” content when prohibited by law or carrier policy). We may suspend or terminate access for violations.

13.) Intellectual Property

All content on the Site, including text, graphics, logos, and other materials, is owned by or licensed to Evo Marketing LLC and is protected by intellectual property laws. You may not use our trademarks or content without our prior written permission.

14.) Purchases, Billing, and Refunds

15.) Disclaimers

16.) Limitation of Liability

To the fullest extent permitted by law, Evo Marketing LLC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost data, or business interruption, arising from or in connection with these Terms, the Site, or the SMS program, even if advised of the possibility of such damages. Our aggregate liability will not exceed the amount you paid to us in the twelve (12) months preceding the claim, if any.

17.) Indemnification

You agree to indemnify, defend, and hold harmless Evo Marketing LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site or SMS program, your violation of these Terms, or your violation of any law or third‑party rights.

21.) Severability and Waiver

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of such right or provision.
